Acceptable Use Policy

EFFECTIVE DATE: JUNE 26, 2023

This Acceptable Use Policy sets out the prohibited uses of the Mochi Services. You and the organization you are representing are independently responsible for complying with all applicable laws and regulations when using Mochi Services, regardless of the purpose of the use.

Prohibited Activities

You may not do the following or similar activities using the Mochi Services:

Permit any third party that is not an Authorized User to access or use a username or password for the Mochi Services;
Share, transfer, or otherwise provide access to an account designated for you to another person;
Use the Mochi Services for any unlawful purpose, including harassment, sending of threats of violence or other unlawful activities, provide material support or resources to any organization(s) designated as terrorist organizations by the relevant laws and regulations concerning national security, defense or terrorism, fraud, among others;
Upload to, or transmit from, the Mochi Services (1) any data, file, software, or link that contains or redirects to a virus, Trojan horse, worm, or other harmful component or (2) a technology that unlawfully accesses or downloads content or information stored within the Mochi Services or on the hardware of Mochi or any third party, or (3) using automated systems or store files that overwhelm our infrastructure by imposing an unreasonably large load on our systems that consume extraordinary resources;
Compromise the integrity of our systems, including probing, scanning, or testing the vulnerability of any system or network that hosts our services, except security assessments expressly permitted by Mochi;
Attempt to reverse engineer, decompile, hack, disable, interfere with, disassemble, modify, copy, translate, or disrupt the features, functionality, integrity, or performance of the Mochi Services (including any mechanism used to restrict or control the functionality of the Mochi Services), any third-party use of the Mochi Services, or any third-party data contained therein (except to the extent such restrictions are prohibited by applicable law);
Decipher any transmissions to or from the servers running the Mochi Services
Attempt to gain unauthorized access to the Mochi Services or related systems or networks or to defeat, avoid, bypass, remove, deactivate, or otherwise circumvent any software protection or monitoring mechanisms of the Mochi Services;access the Mochi Services in order to build a similar or competitive product or service or copy any ideas, features, functions, or graphics of the Services;
Send unsolicited communications, promotions or advertisements, or spam;
Send altered, deceptive or false source-identifying information, including "spoofing" or "phishing";
Abuse referrals or promotions to get more credits than deserved;
Sublicense, resell, time share, or similarly exploit the Mochi Services;
Authorize, permit, enable, induce, or encourage any third party to do any of the above

If we in good faith believe that a violation of this Acceptable Use Policy is deliberate, repeated, or would cause harm to Mochi, the Mochi Services, the Client, the Authorized Users, or any third parties, we may suspend or terminate your access. Violation of this Acceptable Use Policy constitutes a violation of the Mochi User Terms of Service.

Any activity that is inconsistent with the spirit of this Acceptable Use Policy, even if it is something that is not forbidden by the letter of the policy, shall be dealt with accordingly.
